Think you have to finish full probate before you can sell?
Maybe not.
When you sell an inherited property to CashAsIs, we don’t start by telling you to spend months in court before we can even look at the property.
We start with the property and the ownership situation.
Then CashAsIs works with the title company to determine the simplest insurable path to closing.
For some qualifying Texas estates, that path may involve an Affidavit of Heirship rather than completing a full probate administration first.
AFFIDAVIT OF HEIRSHIP → TITLE REVIEW → CLOSE
This is part of the CashAsIs closing process
You don’t need to become an expert in probate law or figure out which documents title will accept.
Tell us about the inherited property and what you know about the family.
If you decide to sell to CashAsIs, we coordinate with title to review items such as:
- how the deceased owner held title;
- whether there is a will;
- the known heirs and family history;
- available death certificates and estate documents;
- existing mortgages, liens, and property taxes; and
- any prior probate proceedings.
The title company then determines what is required for an insurable closing.
When an Affidavit of Heirship may provide a simpler route
Texas law recognizes recorded heirship information as evidence concerning family history and heirship in appropriate circumstances.
For some inherited real estate, the title company may be able to rely on an Affidavit of Heirship and supporting documentation rather than requiring a full court probate administration before the property can be conveyed.
That does not mean every estate can skip probate.
The property history, will, debts, family situation, disputes between heirs, title underwriting, and other facts can change what is required.
But it does mean you should not automatically assume you have to complete an expensive, lengthy probate case before talking to CashAsIs.
Potentially save months of court-related delay
Formal probate is a court process.
Depending on the estate and court schedule, it can involve filings, notices, hearings, appointments, and other procedural steps before the estate has authority to deal with property.
When title determines that a qualifying estate can close through a simpler heirship process, some of those court-related delays may be avoided.
That can matter when:
- the inherited property is vacant;
- taxes and insurance continue to accumulate;
- utilities and maintenance are costing the family money;
- the house needs repairs;
- heirs live in different places; or
- everyone simply wants to finish dealing with the property.
Potentially avoid unnecessary attorney and court expense
Formal probate frequently involves legal representation and court-related costs.
When a full probate administration is not necessary for the particular real-estate closing, using an accepted non-court title solution may reduce some of those expenses.
That can leave more of the property’s value with the family instead of spending money on a process that title did not require for the sale.
CashAsIs does not promise that every estate can avoid probate or attorney involvement. If the estate needs legal counsel or a court proceeding, that requirement still has to be handled.
Our advantage is that we help determine that before you assume the most complicated route is the only route.
You don’t need to pay us a commission
CashAsIs is purchasing the property directly.
There is no traditional real-estate commission charged by CashAsIs for our purchase, and you do not need to repair, renovate, stage, or make the inherited property market-ready for us.
We buy properties as-is.
That means the family can focus on completing the estate instead of spending additional money preparing the property for a traditional sale.
Let CashAsIs and title handle the details
If you’ve inherited a property but probate hasn’t been completed, that does not mean you should wait months before finding out whether you can sell.
Send us:
- The property address
- The deceased owner’s name
- Whether you know of a will
- Who you believe the heirs are
We’ll review the property and give you a CashAsIs offer.
If you decide to move forward, we’ll coordinate with title to determine whether the estate qualifies for a simpler heirship path or whether probate is actually required.
Don’t assume full probate is your only option. Let us see whether there’s a simpler way to get the inherited property sold.
CashAsIs is a property buyer, not a law firm, and does not provide legal advice. Affidavit-of-Heirship, probate, title, and underwriting requirements depend on the estate. Some estates require formal probate or licensed legal counsel.
